I. General part

1. Scope

These general terms and conditions apply exclusively to all e-commerce transactions with our customers from our EDDYCAM shop.

2nd participant

As a provider, we only conclude e-commerce contracts with natural persons with unlimited legal capacity who have reached the age of 18. If the offer of a participant who does not belong to this group of people was accidentally accepted by us, we are entitled to withdraw from the contract with the customer until the contract has been completely fulfilled by both parties, unless the contract is already void or ineffective for other reasons.

3. Conclusion of Contract

The contract is only concluded when we accept the customer order or order. The customer waives a declaration of acceptance. We accept the contract offer with a confirmation by e-mail or at the latest by sending the ordered goods. When ordering several goods, there are separate and independent offers for the conclusion of several purchase contracts for each individual ordered goods. If we determine that individual goods are exceptionally no longer available, we only accept the contract offers with regard to the available or deliverable goods. If offers are not accepted, we will notify the customer immediately by email to the email address provided.

4st Prize

All prices in our EDDYCAM shop include VAT. The customer pays the specified amount in EURO. The prices specified in the web shop only apply to orders there (e-commerce prices) at the time of the order. In addition, there are the respective shipping costs.

Privacy Policy

We guarantee that the customer data arising from orders will only be collected, processed, stored and used in connection with the processing of the order. We only pass on our customer data to affiliated companies for order processing and also pass on this data protection declaration to these companies. If the customer does not want the data to be used for the aforementioned purposes, he is entitled to object to this use at any time in writing or by e-mail.

6. Contact person / availability

We can be reached in writing at any time for all customer concerns at the address given in the EDDYCAM shop.

7. Choice of law

German law applies exclusively to the legal relationships between us and our customers.

8. Miscellaneous

The customer has no right of offsetting or retention unless the claim is undisputed or has been legally established. Place of performance for payments is our place of business. Should individual provisions of this contract not be legally effective in whole or in part or later lose their legal effectiveness, this shall not affect the validity of the rest of the contract. The same applies if the contract has a gap that was not foreseeable by the parties.

9. Liability

We are not liable for damage that we, our representatives or vicarious agents have caused through simple negligence. This limitation of liability does not apply to damage resulting from injury to life, limb or health, from the breach of essential contractual obligations or the lack of guaranteed properties. Liability under the Product Liability Act remains unaffected.

10. Information about online dispute resolution

The EU Commission has provided an internet platform for the online settlement of disputes (so-called "OS platform"). The OS platform is intended to serve as a contact point for the out-of-court settlement of disputes relating to contractual obligations from online sales contracts. II. Special conditions for the purchase of goods

1. Subject matter of the contract

The customer orders goods offered online in the EDDYCAM shop. When ordering goods, we accept this offer to buy if the goods are available and deliverable. We will inform you by e-mail about the acceptance of the contract and send the ordered goods to the customer (sales by mail). In addition to the conditions of the General Section, these special conditions apply to the purchase of goods:

2. Right of withdrawal of the consumer

You have the right to withdraw from this contract within fourteen days without giving any reason. The period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. You can use the attached sample revocation form for this, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences If you withdraw from this contract, we will owe you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you choose a different type of delivery than the cheapest standard delivery offered by us have chosen, have refunded) immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

3. delivery

The goods are delivered by sending them to the shipping costs stated in our offer and to addresses in Germany and other countries.

4. pay

Payment is made in advance. If we can offer you other payment methods, you will find a reference to this in the "Payment" section or in the shopping cart when selecting the payment methods.

5. Default

In the event of default, we will charge the statutory default interest and reminder costs of EUR 3,00 per reminder.

6. Retention of Title

We retain title to all goods supplied by us to a customer until final and full payment for such goods has been received.

7. Warranty

The warranty for defects is 2 years from the invoice date.

8. Restriction on Used Items

Any liability claims for damages (Section I.9) become time-barred within the statutory period.
